Athenia Creative Services, LLC dba Indie Author Training (“Indie Author Training”) is a Nevada Limited Liability Corporation. In these Terms of Use, we will reference ourselves as “Indie Author Training” or “we/us”. This document sets out the terms for use of our Platform. Our platform can be found at IndieAuthorTraining.com, and also includes all of the subdomains, mobile applications, any other media, location, application, etc. owned, managed or otherwise operated by Athenia Creative Services, LLC. When referring to the infrastructure in these Terms, we will be collectively referring to them as the “Platform”.
Indie Author Training is committed to becoming the leading educational and community platform for indie authors. As an instructor on our platform, you play a crucial role in this mission. These Terms of Service are designed to ensure a clear understanding of our mutual obligations and to foster a positive, productive environment for both instructors and students
Code of Conduct
We have to set up some ground rules. Honestly, most of what we cover here should go without saying. However, it’s better to be upfront about things, rather than just assume everyone knows how they are expected to conduct themselves on our Platform. If You violate this Code of Conduct, we reserve the right to remove You and any of Your User Content from the Platform. Whether conduct violates our Code of Conduct will be determined in our sole discretion.
No Illegal Activity:
This is about as simple as it gets. Do not use the Platform for any illegal activity. Period. You are not allowed to use our Platform to engage in any kind of conduct that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from the US or other countries).
No Fraud:
Yes, this is probably covered in the No Illegal Activity section above, but we want to make this very clear. Fraud will not be tolerated in any capacity.
No Bad Conduct:
Do not use the Platform to transmit, distribute, send, or otherwise expose the Platform or its Users to viruses, worms, or any other code that may be deemed dangerous, harmful, or destructive in any manner.
No Spamming:
Seriously. No one likes spam. We don’t like spam. We’re pretty sure that You don’t like your inbox cluttered with spam. You may not use the Platform to engage in any activities that will result in sending spam to anyone on the Platform, including Indie Author Training (and its employees), Instuctors, and Students.
Be Civil:
We mean this. We’re an open platform allowing myriad subject matters to be taught. Not all content is for everyone. But the one thing we can all agree on is that when we use the Platform we are going to be civil and respectful at all times.
No Exploitation:
You will not use the Platform to try to gather personal information on anyone outside of the limited permissible uses for offering or accessing User Content.
No Impersonation:
Imitation is the sincerest form of flattery, but not when it comes to representing that you are a part of Indie Author Training as an employee, or representative of Indie Author Training in any other capacity except as an Instructor and participant.
No Data Mining or Bots:
You may not use any data mining, robots, or similar data gathering or extraction methods.
No Use Other Than Intended:
You may not use the Platform or any User Content contained on the Platform for any purposes other than intended.
No Prohibited Content:
You may not use the Platform if Your User Content contains material that is libelous, slanderous, pornographic, obscene, unlawful, threatening, hateful, violent, predatory, defamatory, or otherwise objectionable, all of which shall be determined in Our sole discretion.
Revenue Sharing and Instructor Packages
- Collaborate With You Package: Enjoy a 60% commission on sales, with extensive support including course development assistance, professional video editing, bespoke course graphics, and strategic marketing efforts to ensure your course reaches its potential audience.
- Bring Your Content Package: For instructors with pre-developed courses, this package offers a 75% commission. It includes migration assistance, platform support, and enhanced promotional opportunities within our network, including Indie Author Magazine.
Intellectual Property and Terms that Apply to Your Data
In operating our Platform, it’s important for us to make it clear who owns what and who’s responsible for what. You are trusting us with Your content and consistent with our genuine belief in transparency we want to make it simple for You to know exactly what You are getting into when You join the our community.
What Athenia Creative Services, LLC Owns
All right, title and interest in and to the Platform, including our information, software, technology, data, applications, logos, marks, designs, text, graphics, pictures, audio and video files, other data or copyrightable materials or content, and their selection and arrangement, is referred to herein as “Indie Author Training Content”, and is and will remain the exclusive property of Athenia Creative Services, LLC dba Indie Author Training and its licensors. Our Content is protected by intellectual property rights both in the United States and internationally.
Intellectual Property and Content Ownership
- Platform Ownership: Indie Author Training retains ownership of the platform’s content, technology, and brand features. Instructors are granted a limited, revocable license to access and use the platform for educational and commercial purposes within the guidelines set forth in these terms.
- Instructor Content Ownership: Instructors maintain ownership of the course content you bring to us. By publishing on Indie Author Training, you grant us a limited license to display, promote, and distribute your content as part of our educational services.
- Improved Content: If you use our services to improve your content, such as video editing, Indie Author Training retains the right to the improved output and the files we create to improve your original video. If you wish to purchase those files and the associated copyright to the improved output, a separate instructor design quote and contact can be requested and the files and rights transferred after payment of the invoice.
Course Management
- Autonomy in Pricing: Instructors have the freedom to set their own course prices. Our platform fees and commissions are transparently calculated based on these prices, ensuring fairness and clarity.
- Commitment to Accessibility: Instructors are responsible for ensuring their courses are accessible, engaging, and up-to-date. Should you choose to withdraw your content, provisions must be made to offer students continued access or appropriate refunds, in line with the promises made at the course’s outset.
Technical Support and Platform Infrastructure
We pride ourselves on offering robust technical support and maintaining a secure, reliable infrastructure. Our platform is built on Amazon AWS servers, with additional support from Cloudflare for content delivery. Instructors and students can expect minimal downtime and 24/7 support.
Departure Policy
Instructors wishing to remove their courses must provide a 30-day notice. This ensures a smooth transition for students, either through course completion, migration to alternative access, or refunds as dictated by the initial course terms.
By participating as an instructor on Indie Author Training, you agree to these terms, crafted to uphold the integrity of our communiversity and the success of our shared educational endeavors.
General Rights In Operating Its Platform
Indie Author Training may remove anyone from the Platform at any time for any reason, solely in our discretion. This right is not modified by any other section of these Terms.
Indie Author Training reserves the right to access Your account, Courses, and User Content in order to respond to requests for technical support, to maintain the safety and security of the Platform, and for other legitimate business purposes, as necessary, in our discretion.
Appointment of Athenia Creative Services, LLC as a Limited Payment Collection Agent
Each Instructor sets his/her/their own prices for the courses they create and assigns the responsibility to Athenia Creative Services for collecting payment for services provided on the platform via Stripe, PayPal, Venmo or other payment gateways Athenia Creative Services assigns.
Each Instructor agrees that payment made by a Student through the Platform shall be considered the same as a payment made directly to the Instructor, and the Instructor will provide the purchased services to the Student in the agreed manner as if the Instructor has received the payment directly from the Student.
Each Instructor agrees that Athenia Creative Services, LLC may refund the Student in accordance with Our general refund policy as follows:
At Indie Author Training, we strive for your complete satisfaction with our courses. If you find that a course does not meet your expectations, we offer a 30-day refund policy from the date of purchase. To request a refund, please contact our support team with your purchase details and a brief explanation of your reason for the refund. Our team will review your request and process refunds promptly, aiming to ensure that your experience with us is positive, even if the course wasn’t the right fit for you.
Each Instructor understands that Indie Author Training’s obligation to pay the Instructor is subject to and conditional upon successful receipt of the associated payments from Students. Indie Author Training guarantees payments to Instuctors only for such amounts that have been successfully received by us from Students in accordance with these Terms.
Payments for course sales will be issued after the 30-day refund period has concluded. This policy ensures that all refunds are adequately processed and settled before the distribution of earnings, aligning with our commitment to fairness and transparency for both instructors and students.
